States’ Fighting Back on Health Care

The most common questions I get revolve around whether the states can legally challenge Obamacare now that it’s passed.  Here’s some great info on this:

Q.  Are certain provisions of proposed federal health care legislation vulnerable to constitutional challenge?  A: Yes, in at least three ways.   Read Clint Bolick’s (of the Goldwater Institute) analysis of the states’ (very good) chances to win this battle in the courts.                                                                                                                                                         The media is beginning to take note that 41 states besides Arizona have now either proposed laws that will protect patients’ rights, or they have passed them.  Read States Battle Feds on Healthcare in last week’s USA TodayThey interviewed me for this article last summer right after the Arizona Legislature referred the Arizona Healthcare Freedom Act to the ballot – but now that so many states are on moving to protect their citizens’ health care rights, I guess they decided to take this movement seriously.  Here’s more: State by State: Who’s Looking to Counter Health Reform.
